The Facilities User understands and agrees to the following:
1. At Will Use.
a. Virginia Mennonite Missions, a Virginia nonprofit corporation (“VMMissions”) is the owner (“Owner”) of the Mission Training Center ("The Barn"). VMMissions chooses to make The Barn available for short-term, non-interfering use as a service to partnering churches, organizations or ministry groups. VMMissions intends that The Barn be used primarily for events related to equipping God's church in mission and ministry. Requests for personal use will not be granted. Permission for any church, organization or ministry group to use its facilities is at VMMissions’ sole discretion which it may withhold or withdraw at any time, with or without cause. The Facilities User may also cancel use of the Facilities at any time by notifying VMMissions via email.
b. The Facilities are available free of charge. However, donations are welcome to help with upkeep and maintenance of the Facilities. Please make checks out to “VMMissions” or donate online here.
2. Facilities Use Expectations.
a. The Facilities User will use the Facilities consistent with the stated Use.
b. The Facilities User will not use the premises for any purposes contrary to the mission, purpose or belief of VMMissions, which is a biblically-based religious institution. (See the VMMissions Lifestyle Covenant.) No tobacco, drugs, alcohol or firearms are permitted on VMMissions’ premises.
c. The Facilities User will not use the premises for any unlawful purposes, and will obey all laws, rules, and regulations of all governmental authorities while using the above described facilities.
d. The Facilities User is solely responsible to implement appropriate screening and supervision procedures to protect children, youth, and vulnerable adults attending the Facilities User’s function at the above facilities.
e. The Facilities User will not use VMMissions’ consumable products, such as coffee, tea, food, paper plates, etc.
f. The Facilities will be left as it was found (i.e., furniture in the same configuration, used dishes clean and put away, lights turned off, doors locked, floors and carpets free of debris, AV equipment powered off, full trash cans emptied into outside bin).
g. The Facilities User will conduct a visual inspection of the premises, including entrances and exits, prior to each use, and warrants that the premises will be used only if it is in a safe condition.
3. Personnel.
VMMissions will familiarize the Facilities User with the Facilities during office hours prior to use of the Facilities so that the Facilities can be used without VMMissions’ personnel present or available. VMMissions does not commit to availability (in person or “on call”) for the Facilities User’s use of the Facilities.
4. Damages.
In the event of property damage by the Facilities User or its guests which is not covered by VMMissions’ insurance, the Facilities User will be responsible to pay for the costs of repair or replacement of such property.
5. Inclement Weather.
VMMissions cannot commit to ice and snow removal to accommodate the Facilities User’s use of the Facilities so, in the event of snow or ice, the Facilities will be deemed unavailable and the Facilities User should cancel use of the Facilities.
6. Cancellation.
In the event that weather forces the cancellation of the Facilities User’s event, or if VMMissions chooses to cancel the agreement, VMMissions will in no event be liable to the Facilities User for any lost revenue or incidental, indirect, special, or consequential damages arising out of the Facilities User’s inability to use the above premises.
7. Emergency.
A fire extinguisher and first aid kit are located in the kitchen. If additional emergency or safety equipment is desired, it should be secured by the Facilities User. The Facilities User should use a personal cell phone to dial “911” and give the address as 601 Parkwood Drive, Harrisonburg, Virginia.
8. Release and Hold Harmless.
In consideration of the use of VMMissions’ facilities, the Facilities User waives and releases, to the fullest extent permitted by law, any and all claims, actions, or causes of action for any damages or loss for bodily injury, property damage or theft, wrongful death, loss of services, or other claim that it might have against VMMissions, its employees, volunteers, and agents, and indemnifies and holds them harmless for all costs and expenses, including reasonable attorneys’ fees, related to the use of VMMissions’ facilities. THIS IS A RELEASE given in consideration for the use of VMMissions’ facilities.
The Facilities User, by its authorized agent named below, requests use of the Facilities for the Term according to information provided above, and agrees that, upon VMMissions’ approval of this request, the Facilities User will become bound to the terms and conditions stated above.
